What is Probate?

Probate is the court procedure by which the decedents will is accepted by the Court unless it is successfully challenged by a beneficiary or potential beneficiary. In addition, property of your loved one is located and inventoried, unpaid creditors of your loved one are given the opportunity to file claims against the estate, and fees for the administration of the estate are approved and paid.  Once all of the creditors are paid, the probate assets are then distributed to the beneficiaries.
