In 2005, Congress changed the Federal bankruptcy law under pressure from banks and credit card companies. The new bankruptcy law makes filing a lot more complicated, and most attorneys aren’t familiar with the changes.  For example, you now must have certification of credit counseling from an approved agency before you can file.

CHAPTER 13

Chapter 13 assists honest, hardworking people who have debt problems.  It gives them an opportunity to pay off creditors by spreading their current debts over a period of 3-5 years. Chapter 13 can help you:

  1. Save your home from foreclosure
  2. Keep your car from being repossessed
  3. Reduce your monthly payments
  4. Stop creditors from harassing or even contacting you

Any past debt can be included in your plan including medical bills, credit card debt and personal loans, past due taxes, and utility bills. Past due mortgage and car loan payments can be included in the plan as well.

CHAPTER 7

In some instances, Chapter 7 may be more beneficial to resolve financial difficulties and is still available for many debtors.
